USA:s vicepresident är näst efter presidenten i successionsordningen, och blir tilldelad presidentämbetet då den sittande presidenten dör, avgår eller på annat sätt fråntas sitt ämbete. USA:s konstitution tilldelar vicepresidenten ex officio posten som talman i USA:s senat och har där utslagsröst vid lika röstetal. Nuvarande vicepresident är Joe Biden.

Vicepresidenten måste vara född amerikansk medborgare, minst 35 år gammal och ha levt i USA de senaste 14 åren. Vicepresidenten måste, enligt konstitutionen, uppfylla samma behörighetskrav som presidenten och kan heller inte innehaft presidentämbetet över två mandatperioder på fyra respektive minst två år (varje tidsperiod på minst två år räknas som en mandatperiod).

Vicepresidentens residens är Number One Observatory Circle.

Till skillnad från presidentämbetet saknas det i konstitutionen en ed för vicepresidenten att avläggas vid tillsättandet. Sedan 1789 har det använts flera varianter, dock har det sedan 1884 använts samma ed som vid tillsättandet av senatorer, ledamöter av representanthuset och övriga regeringsmedlemmar:

”I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.” [1]
